Terms of Service

 

To use Mlem by The Edo sp. z o.o. you have to be at least 16 years of age. By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to The Edo. sp. z o.o.

The Edo sp. z o.o. is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Mlem app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Mlem app won’t work properly or at all.

The app does use third party services that declare their own Terms and Conditions.

You should be aware that there are certain things that The Edo. sp. z o.o. will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but The Edo. sp. z o.o. cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, The Edo. sp. z o.o. cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, The Edo. sp z o.o. cannot accept responsibility.

With respect to The Edo. sp. z o.o.’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. The Edo. sp. z o.o. accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. The Edo. sp. z o.o. does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

PROFILE CONTENT

Within the app you have to apply to following rules regarding profile content:

  1. ADVERTISEMENT: You are not allowed to use your profile for advertisement any services, products, political views or anything that can be used to gain profit or popularity, with an exception of personal gaming – related social media that you own and run non-commercially or semi-commercially, like twitch channel, instagram profile or youtube channel. 
  2. RECRUITMENT: You are not allowed to use your profile or app communication system to recruit users to any group, server, community, forum or similar. Especially spamming multiple users with recruitment offers, posting discord servers or gaming communities advertisements or inviting elsewhere. 
  3. EXPLICIT CONTENT: You are not allowed to present any explicit content, nudity, sexually suggestive content, content presenting blood or gore. Do not post your unusual sexual preferences and desires in your profile.
  4. OFFENSIVE CONTENT: You are not allowed to present any content that could be harmful or offensive for other users or content that defames. Especially content offensive to minorities, racist content, content suggesting any national, racial or sexual superiority either explicitly or by jokes, suggestions and metaphors.
  5. IMPERSONATION: You are not allowed to cheat other users into thinking that you are someone else than you are in real life by posting or suggesting information other than your real age, gender, occupation or any other. Do not post links to external websites on Mlem .
  6. DATING RELATED CONTENT: Mlem is an app made with only one purpose in mind: to help gamers find gamer friends. You are not allowed to post any content directly suggesting that you are using the app with the intention to meet sexual or romantic partners.
  7. PERSONAL INFORMATION: Do not publicly broadcast your personal information, such as full name, email address, ID number, security number, passwords or similar. 
  8. MULTIPLE ACCOUNTS: Do not create another account if your previous account was disabled, share your account with anyone or own multiple accounts.

INTERACTIONS

In interactions with other users you have to behave respectfully and tactful, and to follow rules regarding messaging:

  1. SPAM: You are not allowed to repeatedly send the same message to multiple users to promote, recruit to groups or communities or advertise anything.
  2. PERSONAL DATA EXTORTION: You are not allowed to ask other users for their personal data such as emails, gamer tags, whatsapp or phone numbers, social security numbers and similar, or anyhow encouraging them to leave the app to communicate with you elsewhere.
  3. INSULT: You are not allowed to behave offensively, insult other users, troll other users (for example by starting pointless and controversial arguments for the sake of controversy) or to be anyhow intentionally harmful or unpleasant.
  4. SEXUAL HARASSMENT: You are not allowed to engage, or encourage others to engage, in any targeted abuse or harassment against any other user. This includes sending any unsolicited sexual content.
  5. VIOLENCE: Even the slightest suggestion of violence towards other users will not be tolerated. You are not allowed to bully, “stalk”, intimidate, assault, harass, mistreat or defame any person.

GENERAL RULES

You also agree to general rules:

  1. LEGALITY: Do not post or converse about anything illegal. If it is illegal in real life, it is illegal in the app.
  2. PROTECT INFORMATION: Never share your personal information within the app, such as full name, address, phone number etc. The Edo sp z o.o. Is not liable for any harm that could result in misuse of your data.
  3. REPORT ALL SUSPICIOUS ACTIVITY: Do report all suspicious activity within the app, using the provided report system. 
  4. PROTECT ACCOUNT: Use a strong password, never share your account details and protect devices that you are using to access your account, especially in public places. The Edo sp. z o.o. Will never ask you for your login or password in any communication.
  5. Mlem ENDORSEMENT: Do not express or imply that any statements you make, or content you publish is anyhow endorsed or approved by Mlem and The Edo sp. z o.o. Do not associate yourself with Mlem without our permission and do not imply any connection with The Edo sp. z o.o. , developer team or app moderator team.
  6. COMMUNICATION: Do not harass, be insulting offensive towards Mlem developer team, support or any other The Edo sp. z o.o. employee. 
  7. ACCOUNT TERMINATION: The Edo sp. z o.o. Reserves the right to terminate your account without providing any reason, any alert and any previous notice.

VIOLATION

Violation of the rules will result in your account being terminated without prior notice. By using the app you also agree that your content will be reviewed by The Edo sp. z o.o. Moderator team if any suspicion of breaking these terms occurs is raised either by other users’ reports or team itself, and in cases when it will be required – all your data will be shared with proper authorities to comply with the legal process. 

You also agree that the content of your in-app public profile (including photo, description and badges / platforms / games selections) can be used by The Edo. sp. z o.o. And enabled third parties as app screenshot for promotional purposes, as app preview in app store and play store, on app website and social media. We will however never use your data outside of the context of the app or link it with you anyhow, unless requested.

PURCHASES

The Edo sp. z o.o. offers products of services as ‘in-app-purchases’ through the app store proper for your device that carries the billing. If you choose to make a purchase you will be prompted by authorized store payment process and charged amount specified in product description with addition of any taxes required by your local law. Refunds and reclamations will be held by the proper app store that handles the billing and payment process: either Apple App Store or Google Play Store.

CHANGES

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
